Terms & conditions
1. Scope and provider
These terms apply to all orders placed by consumers in the online shop of Areias – Iracema Siqueira Gonçalves (hereinafter "we") at areiasalgarve.com. The provider is the operator named in the Legal notice.
2. Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By submitting your order you make a binding offer. The contract is concluded when we accept the order by confirming it via email or by dispatching the goods.
3. Prices and shipping costs
All prices are in euros. VAT is not charged — the provider is a small business exempt from VAT (regime de isenção under Article 53 of the Portuguese VAT Code, CIVA). Any shipping costs are shown separately before the order is completed.
4. Payment
We offer the following payment methods: [e.g. credit card, Multibanco, MB WAY, PayPal]. Processing is handled by our payment provider [e.g. Stripe].
5. Delivery
Delivery is made to the address you provide within 3–6 business days (Portugal) or 6–10 business days (rest of the EU) of receipt of payment. Delivery is available to [delivery countries]. For deliveries outside the EU, additional customs duties and import charges may apply, which you bear.
6. Retention of title
The goods remain our property until full payment has been received.
7. Right of withdrawal
As a consumer you have a statutory right of withdrawal. For details see Right of withdrawal.
8. Warranty of conformity
The statutory provisions on the conformity of goods apply (in Portugal, Decreto-Lei n.º 84/2021). In the event of non-conformity you are entitled, in accordance with the law, to have conformity restored, to a price reduction or to termination of the contract.
9. Selected pieces
Our jewellery is carefully selected. Minor variations in colour, texture or shape compared with the product photos are inherent to the material and batch and do not constitute a defect.
10. Applicable law and dispute resolution
Portuguese law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of habitual residence remain unaffected. On dispute resolution, see Complaints book.
Right of withdrawal
Consumers have a fourteen-day right of withdrawal (Decreto-Lei n.º 24/2014; EU Consumer Rights Directive 2011/83/EU).
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period expires fourteen days from the day on which you, or a third party other than the carrier indicated by you, acquire physical possession of the goods.
To exercise your right of withdrawal, you must inform us (Areias – Iracema Siqueira Gonçalves, Urb. Pine Sun Park, Bloco 17, 2 F, 8200-380 Albufeira, Portugal, iracemasiqueira83@gmail.com, [phone]) of your decision to withdraw from this contract by a clear statement (e.g. a letter or email). You may use the model withdrawal form below, though it is not obligatory. To meet the withdrawal deadline it is sufficient for you to send your communication before the period has expired.
Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we are informed of your decision to withdraw.
We will make the reimbursement using the same means of payment you used for the initial transaction, unless expressly agreed otherwise; in any event you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and no later than fourteen days from the day on which you communicate your withdrawal. The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion of the right of withdrawal
The right of withdrawal does not apply to goods made to the customer's specifications or clearly personalised (for example, engraved or made-to-measure pieces).
